1. INTRODUCTION
The Pike mobile application (“App”) and accompanying websites located at getpike.com, pike.fyi, and app.getpike.com (collectively, the “Websites”) and any related software or service available on or through the App or Websites (collectively, the App and the Websites and any related interactions you may have with us shall be referred to herein as the “Services”) are operated by Pike LLC and its affiliates (collectively, “Pike”, “we,” “us,” or“ our”). This Privacy Policy explains how we collect, use, and disclose your Personal Information when you access or use the Services.

This Privacy Policy only applies to the Services identified above. Other sites, apps, services, or other online content, including any third-party social media platforms you use to interact with Pike, may have their own separate privacy policies which should be reviewed.

The Services are intended for users 18 years of age or older. If you are not 18 years of age or older, you are NOT permitted to access or use the Services. We do not knowingly solicitor collect the Personal Information of a child under the age of 18. If you learn that anyone younger than 18 years old has unlawfully provided us with Personal Information, please contact us, and we will take steps to delete such information. 

2. TERMS OF USE
This Privacy Policy is incorporated into and governed by our Terms of Use.

By accessing the Services and/or submitting your Personal Information to us, you agree to the terms set forth in this Privacy Policy and consent to the collection, use, and disclosure of Personal Information as described herein (including to contact you). IF YOU DO NOT ACCEPT THE TERMS OF THIS PRIVACY POLICY, DO NOT ACCESS OR USE THE SERVICES.

3. UPDATES TO THIS PRIVACY POLICY
We may update this Privacy Policy from time to time by posting a modified version of this Privacy Policy and its effective date on this page. Our Privacy Policy’s effective date will always be set forth at the end of the Privacy Policy. Accordingly, you should visit this page periodically to identify and understand any such changes to this Privacy Policy. Any changes will be immediately incorporated into this Privacy Policy and will be prospective only. We will not make any changes that have retroactive effect unless legally required to do so. We will not collect new types of Personal Information beyond what is disclosed in this Privacy Policy without providing you notice prior to the collection of that Personal Information. We will not use your Personal Information for an unexpected purpose beyond what is disclosed in this Privacy Policy without first providing you notice of such change by posting a revised Privacy Policy with a new effective date and, to the extent required under law, obtaining your consent. 

By continuing to access or use the Services after a modification, you agree to be bound by the modified Privacy Policy. 

4. OUR DATA PROCESSING ACTIVITIES
Information We Collect 

We may collect Personal Information when you use our Services or send us inquiries. What is considered “Personal Information” may vary under different privacy laws, but it generally refers to information that, alone or in combination with other data, is reasonably capable of identifying or being associated with an identifiable individual or, in some cases, an individual’s household. Personal Information does not include data that is anonymized or de-identified. Under certain privacy laws, Personal Information also does not include publicly available information. The specific types of Personal Information that we may collect may vary depending on whether you are using our Websites or App or other Services. Other than precise geolocation data, which we collect pursuant to your consent, we do not knowingly collect sensitive Personal Information about you unless you choose to provide such information to us. If you voluntarily choose to provide sensitive Personal Information to us, you hereby consent to us processing this information pursuant to this Privacy Policy.

Use Of Your Information 

We may use your Personal Information for the following purposes:
• To contact you regarding the Services;
• To process your questions and requests;
• To provide the Services to you;
• To track and analyze usage in connection with our Services;
• For internal research and marketing purposes including to administer contests, promotions, surveys, or other features for the Services;
• To better respond to your individual needs including providing personalized content/guides based on your location and interests;
• To improve the Services;
• To improve customer service and personalize your experience when using the Services;
• To send periodic news and updates pertaining to Pike;
• To generate new Pike content from user generated content;
• To create behavioral patterns based on your interaction with the Services and the content you create which are used (i) to provide customized content and services to our users and(ii) to create anonymized and aggregated customer segments and trends reports(that do not identify our users) which are shared with third parties who provide relevant advertisements and/or offer relevant products and services on our App and Websites;
• To disclose a potential buyer as an asset in connection with a proposed or actual merger or sale (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate organization, stock sale or other change in control;
• To protect our rights or property or the security or integrity of our Services;
• To enforce our Terms of Use or other applicable agreements or policies;
• To verify your identity;
• To monitor, investigate, detect, and prevent fraud, security breaches and other potentially prohibited or illegal activities;
• To comply with applicable law, regulation, legal process, or governmental request; and
• For any other purpose disclosed to you or to which you consent.

To the extent permitted by law, we reserve the right to contact you at any time to provide information, respond to questions or provide notification of any changes to our Services or policies.

Disclosure Of Your Information
We may use third party providers to process and store your Personal Information in United States. While we take measures to ensure protection of your Personal Information, governments, courts, law enforcement or regulatory agencies in another country may be able to obtain disclosure of information through the laws of such country. We may disclose your Personal Information as follows:

• With our affiliates for the purposes described above;
• With third parties to provide, maintain, and improve our Services including service providers who access Personal Information about you to perform Services on our behalf such as, for example, website, app, and chat design/management, and IT maintenance and support and data storage;
• With law enforcement and judicial and regulatory authorities, when permitted or required by law, such as in response to a subpoena or other legal process or governmental request or to meet legal obligations, including but not limited to disclosures pursuant to regulatory reporting requirements;
• To an entity buying all or substantially all of Pike’s assets or ownership interests, subject to an appropriate non-disclosure agreement;
• To third party data analytics and social media providers, advertisers, and other business partners to provide relevant advertisements and to offer goods and/or services to you;
• To third parties when we believe disclosure is reasonably necessary to (i) enforce or comply with our Terms of Use or other applicable agreements or policies, (ii) to protect our rights or property, or security or integrity of our Services, or (iii) to protect us, our users, or the public from harm or potentially prohibited or illegal activities; and
• To other third parties with your consent where required by applicable law.

For the avoidance of doubt, if you use our chat function your chat communications with us and/or other users may be accessible by our service providers to manage the chat function. By using the chat function, you consent to such third-party access.

5. COOKIES AND ONLINE TRACKING 
A cookie is a data file transferred to your device that allows us to maintain your unique preferences when visiting and navigating our Websites. Log file information is automatically reported by your browser or mobile device each time you access the Services. When you use our Services, our servers automatically record certain log file information such as your browser type, IP address, pages viewed, and other such information. We use cookies and similar technologies to improve usability of our Services, log you into Services, to save your preferences, personalize content you see, for statistical and analytical purposes and to provide targeted advertising that may be of interest to you.

General Browser Privacy Settings
You can choose how cookies and similar technologies are handled by your device through your browser settings. If you are concerned about the use of cookies or similar technologies, you can block, disable and/or clear them using your browser. If you choose to block or disable cookies or similar technologies, the Websites may not function properly, and certain features may not be available.

Plugins
A plugin is a small piece of software that adds specific functionality or content to a website or mobile application. Common types of plugins are used to help websites function such as running animation, videos, open Adobe pdfs., print documents, and customized website fonts and images.Websites may also have a ‘social media plugin’, which allows a website user to connect to an organization’s social media page directly from the organization’s website. If the user has a social media account, the user may be able to interact with their social media account on websites they visit. For example, the social media account user may be able to ‘like’ or ‘share’ content on a website which then may be shared on the social media page. When using social media plugins, certain information about website users may be collected and shared with the third-party social media provider.

On our Websites and App, we use the social media plugins in the table below. You may opt out of having information shared with social media companies by following the directions noted in the table below.

Tracking Pixels /SDKs
A tracking pixel is a tiny invisible image embedded within a website that can be used to gather information about your device and browser. A software development kit (SDK) is a piece of code that can be used to gather information about your mobile device. Such device information may include your IP addressor meta data derived from your IP address, along with information about your activity while on a website such as:

i. which pages you viewed, and the length of time you spent on a particular page;
ii. what ads, videos, or third-party links you clicked on while using our Websites and/or App;
iii. particular websites you have visited prior to or after visiting our Websites,
iv. your approximate age, gender, interests, and preferred language; and
v. your general location (city, state, and country) (based on IP address) (collectively, “Pixel Information”). 

This Pixel Information is then used by us for purposes of: (i) providing personalized location- based content on our App; (ii) analyzing your interactions with the Services in order to maximize your experience with the Services and help us improve the content and provision of the Services; and (iii) for our own advertising and marketing purposes. We may further share your Pixel Information with other third parties, including social media providers, advertisers, and other business partners, for online behavioral advertising purposes. Please see our Online Behavioral Advertising section below for further information. A tracking pixel can also be used on emails to help track the success of our email communications to you by seeing when you opened our email and/or clicked on any email embedded links.

On our Websites and App, we use the tracking pixels in the Table below. You may opt out of being tracked through these tracking pixels by following the directions noted in the table below.

Google Analytics
Our Websites and App use Google Analytics, a web analytics service provided by Google Inc. (“Google”), that uses tracking technologies to analyze your use of and interaction with our Websites and App. Information that Google may collect for this purpose may include page views, scrolls, videos, or links that were clicked, a unique client ID attributable to your device and browser information, your approximate age, gender, interests, language settings on your device or browser, and approximate location metadata derived from your IP address (city, state, and country)(collectively, “Google Analytics Data”). Google Analytics Data is transmitted to and stored on a Google server in the United States where it analyzed for purposes of generating reports on traffic patterns on webpages and/or posted content when using our Services (“Google Analytics Report”). Google provides us with the Google Analytics Reports so that we may tailor our Websites and/or App to accommodate the needs of our users. Google may also transfer Google Analytics Data and Google Analytics Reports to third parties, if required by law or if third parties process such information on behalf of Google. 6. MOBILE DEVICEDATA COLLECTION
If you access our Services through our App, we may collect the following Personal Information about you: your device identifier, your mobile device’s operating system type, your mobile carrier, and your geolocation (your location while you are using the App) (see below for further details). Depending on how you interact with our App, we may also collect additional information that you provide to us including contact information, log in credentials, our App items that you add to your “favorites” and/or“ interests” lists, any posts, or communications you make on our App, and your browsing/activity within and when using the App. We may also access your contacts list and photos on your mobile device for the purpose of inviting your friends to our App and/or when you choose to post photos on our App, but only if you provide your consent.

In order to provide customized content/guides to you pursuant to the Services we use GPS technology (or other similar technology) to collect your precise geolocation data when you first log into the App and thereafter when you use the location map function within the App, but only if you provide your consent. If you consent to the collection of your precise geolocation information, we may display a location map with relevant advertisements based on your location and any inferences made from such location.

We may also provide anonymized and aggregated customer segment data across our users that are derived from your general location based on your interests at the city, state, or country level (e.g., Brooklyn) to our third-party partners for purposes of offering relevant goods or services to our users on the App and Websites. We will not share precise geolocation data with third parties for advertising purposes.

If you do not want us to use your location for the purposes set forth above, you should turn off the location services located in your account settings or in your mobile phone settings and/or within the App. To opt out of certain data collection and sharing through the App please go to your mobile device settings and follow the instructions for your particular device (See instructions for Apple &Android). To opt out of targeted ads while using the App, you can also opt out using the Digital Advertising Alliance’s free mobile application App Choices for each device you use.

Standard data and other fees may be charged by your mobile phone carrier when using the App, so please be aware of such fees. 

7. ONLINE BEHAVIORAL ADVERTISING
We may tailor advertisements that are sent to you based on information that gives us a sense of what interests you, such as information collected from your activity and/or created content on the Websites or App as well as your activity on other third-party websites and/or your responses to our promotional emails. We share this information with third party advertisers, social media providers, and other business partners so that they use this information to:

• Leverage users’ interests, viewing behaviors and interactions to deliver relevant ads tailored to their business goals;
• Serve ads to people on our App and Websites who are actively searching for products and services, right at that very moment and based on their general geo-location at the city, state, and country level only (precise geolocation data is not used nor shared with social media providers, advertisers, or business partners for advertising purposes);
• Track visitor actions, create audience segments or lookalikes, re-engage previous site visitors, and find new customers;
• Monitor and measure web and app conversions from their campaigns on the Pike Websites and App; and
• Use web attribution and activity to track return on ad spend, track conversions, evaluate the effectiveness of the digital ads you receive, analyze key advertising metrics, and gain insights on the performance of their ads in general.

To opt out of tracking for online behavioral advertising purposes please see the Cookies and Online Tracking section. You can also opt out by clicking the “Do Not Sell or Share my Personal Information” button on our website and filling out the online form. To learn more about other ways to possibly opt-out of certain kinds of tracking that occur when you browse the internet and lead to targeted advertising, visit the Network Advertising Initiative website and the Digital Advertising Alliance website.

Please note that options you select are browser- and device-specific, and there is no guarantee that these industry-provided opt-out tools will prevent all targeted advertising. As previously described in this Privacy Policy, third parties may collect or receive information through the Services. Since it is possible that some of these third parties may respond differently than us to “do not track” requests, you should consult the applicable privacy policies of those third parties for further information.

8. RETENTION OF YOUR INFORMATION
We retain Personal Information only as long as necessary to fulfill the purpose(s) for which such information was collected or to fulfill other legitimate purposes such as ensuring security of our data and systems, complying with our legal obligations, complying with tax, audit, or other books and record policies, resolving disputes, and conducting internal investigations, and enforcing our agreements or other legal rights. Due to the different purposes for retaining your Personal Information, the actual retention timeframes may vary depending on the type of Personal Information we collect from you. Please see the Table below further describing our data retention timeframes or the methodology we use to determine how long we retain Personal Information. If we determine that your Personal Information is no longer needed for the purposes described above, it will be deleted or anonymized so that it can no longer be attributed to you. Please note that residual copies of your Personal Information may be removed from backup systems subject to our backup data retention schedule. You may request deletion of your account by going to the account settings of the App and clicking, “Delete my account.”

WE ARE NOT RESPONSIBLE FOR DELETING THE PERSONAL INFORMATION AND OTHER NON- IDENTIFYING INFORMATION YOU CHOOSE TO POST IN ANY PUBLICLY ACCESSIBLE AREA OF THE SERVICES.

We use security safeguards appropriate to the size, complexity, nature and scope of our activities and the sensitivity of the information to address the risk of loss, misuse, alteration, or unauthorized disclosure of Personal Information under our control. While we have employed security technologies and procedures to assist in safeguarding your Personal Information, no system or network can be guaranteed to be 100% secure, and we cannot guarantee that the information you send over the internet is fully secure. You should exercise discretion in what information you disclose and/or transmit through our Services. The transmitted information may be intercepted by others before it reaches us. If you are concerned about sending information to us over the internet, please send the information by mail or call us to make other arrangements. We are not responsible for the security of information transmitted online. Likewise, when you click on third-party links from our Services, we cannot control the security measures used on such third-party sites or applications. If you have an account with us, you are responsible for maintaining the secrecy of your log in credentials and account information, and for controlling access to your email account and any electronic communications from us.

10. LINKS We may permit certain third parties (including social media services, external websites, and/or external mobile applications) to link to our Services, and the Services may contain links to third- party sites or applications. We are not responsible for the privacy policies or practices of such third parties, including their level of data sharing with other third parties. When linking to a third- party website or mobile application or using a particular internet browser service, you should first read the privacy policy of such third-party website, mobile application, or internet browser. 

11. PRIVACY RIGHTS
Depending on where you reside, you may have certain rights or choices that allow you to make requests with respect to your Personal Information including (subject to applicable legal exceptions) rights or choices to:
• Obtain details about how we collect, use, and share your Personal Information;
• Access a copy of your Personal Information;
• Delete your Personal Information (unless an exception under law applies);
• Correct your Personal Information;
• Opt-out of the sale of your Personal Information or sharing for targeted advertising purposes based on your browsing behavior before and after you visit or use the Services;
• Opt-out of any processing of your Personal Information for the purposes of creating a profile based on your interests or behavior which is used in such a way that would produce legal ramifications or similarly significant real-world effects on you;
• Opt-out of any automated decision-making activities made with respect to your Personal Information (if applicable);
• Limit processing of your sensitive Personal Information for purposes of inferring characteristics about you;
• Submit an appeal to a regulatory authority if we reject your request; and/or
• Not have discriminatory action taken against you for exercising your rights. 

12. HOW TO SUBMIT A PRIVACY REQUEST
If you would like to exercise any of the rights described in the Privacy Rights section above(“Privacy Request”), please contact us or fill out our online request form. We will not discriminate against you for exercising your rights under applicable privacy laws. Further details on the steps needed to process your Privacy Request are detailed below. 

Step 1: Verifying your Request.
Before we can fulfill your Privacy Request, we need to(i) verify your identity or your authority to make the request(if you are submitting a Privacy Request as an agent) and (ii) confirm that thePersonal Information you are requesting belongs to you. If you have a password-protected account with us, we may use our existing authentication procedures to verify your identity, however, you are not required to have an account with us to make a Privacy Request. For most other requests, we will ask you to provide information that matches at least two pieces of Personal Information we store about you before responding to your Privacy Request. If you would like to request specific pieces Personal Information that we have collected, or if you would like us to delete highly sensitive Personal Information, you will need to match at least three pieces of information we store about you, and you must provide a signed declaration under penalty of perjury that you are the consumer whose Personal Information you are requesting. We may refuse any request made regarding collected Personal Information if we are unable to verify the identity of the person making the request or if we cannot authenticate the legitimacy of the request using commercially reasonable efforts. Under such circumstances, we may follow up with you for additional information as reasonably necessary to authenticate your request. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Authorized Agents 
You may grant an authorized agent written permission to submit Privacy Requests, but we may deny authorized agent requests if we are unable to verify your identity directly as the subject of the Personal Information at issue. To verify a request from an authorized agent, we may require proof that you gave the authorized agent signed permission to submit the Privacy Request, such as by requiring you to directly confirm with us that you provided permission for the authorized agent to submit your request, and/or we may ask you to verify your identity directly with us.

Step 2: Responding to your Request. After verifying your identity, we will respond to your request by either fulfilling your request or explaining why we are denying your request. The timeframe in which we respond will vary based on the applicable law where you reside. If we deny your request, you may have the option under applicable law to appeal this decision by contacting us using the contact methods described above. If you are concerned with the result of your appeal, you may have the right to contact your State Attorney General or applicable data protection supervisory authority. 

Deletion Requests 
Please note that for deletion requests, any removal of content by us does not ensure or guarantee complete or comprehensive removal in all places. The content may have been shared or reposted by other parties who act outside of any business relationship with us or may not cooperate with our request for them to delete your Personal Information. Federal or state law also may require maintenance of the content or information. We will do our best to accommodate your request, but we cannot guarantee we can remove all Personal Information from the specified uses. Therefore, please be as specific as possible in your request. If the request relates to information that we need to make the Services function properly for you, you may not be able to use the Services properly moving forward. We reserve the right to maintain proper business records as required by law, or for otherwise legitimate business purposes to the extent permitted bylaw, even if such records contain your Personal Information. 

Opt-Out Requests
As discussed in the Privacy Rights section above, you may have the right to opt out of certain uses or disclosures of your Personal Information. To exercise these rights please send an email to support@getpike.com with a subject ‘Do Not Sell or Share my Personal Information’. In the message include the words Opt-Out, along with your username / handle for the account that you want this change to be applied.

13. CALIFORNIA PRIVACYRIGHTS 
Individuals who are residents of California may have additional rights under California law. Please see the CCPA Addendum below for further information on how we process your Personal Information and your rights under California law. 

14. RESIDENTS OUTSIDE OF THE UNITED STATES
Individuals who reside outside of the United States may have additional privacy protections under applicable law. For further information, please see our International Addendum.  

 15. ACCOUNT DELETION
